There have been press reports that the Commonwealth Ombudsman has received and is investigating a complaint concerning an incident involving detainees at the Port Hedland Immigration Reception and Processing Centre (IRPC) in early December 2003.

The Commonwealth Ombudsman, Professor John McMillan, has confirmed that preliminary inquiries are being undertaken. At this stage the Ombudsman’s office has viewed video records and incident reports. The Department of Immigration and Multicultural and Indigenous Affairs has appointed an expert consultant, to assist an internal investigation and to visit Port Hedland and to collect data and prepare a report.

The Commonwealth Ombudsman will be providing advice on the terms of reference for the consultant’s visit and report, and will monitor the inquiry conducted by the consultant. After a report is received the Commonwealth Ombudsman will undertake an independent analysis of any report and decide what further action if any is required.

It is not expected that this process of investigation and report will be completed before late January. It may be premature to make any further statement pending the completion of this preliminary phase of investigation.
